What’s the Difference Between a Notary Public and a Notario Publico?

This month, I have been in the beautiful state of Chiapas, Mexico. Of course, it is vacation, but it has been an opportunity for me to continually learn Spanish and learn more about the Latin American culture.

One key difference is what a notary public is in the United States versus what a Notario Publico is in Latin America.

A notary public in Oregon is someone who administers oaths, witnesses signatures, and verifies the identity of the signer. We are not allowed or trained to offer any legal advice regarding immigration, or any other important legal matters. When you have a document that requires a notarization, our stamp confirms your identity and makes the form more enforceable. A notarial stamp does not confirm the legality of the document being presented.

In Mexico and other Latin American countries, a notario publico is someone who has a degree in law. They can offer legal advice, file deeds, and even mediate legal disputes. Their role is most similar to a lawyer of judge in the Unites States, and not like a notary public at all.

Because the direct translation of notario publico is notary public, it is important to understand that culturally, these are completely different services.
